My name is Antonio Guerra; I live in Bogotá, Colombia, S.A.
I have been a scriptwriter for the last four years and with a group we created the only TV animated series produced in Colombia, until now. Due to this we were contacted by a company owner of a successful internet site for teenagers, to develop its logo (a little devil by the name of “titiri”), in a project for a t.v. series destined to the international market.
We that aim we created a complete set for “titiri”: its personality, family, ambience and a manual or “bible” with the series general outlook, summary of principal and secondary characters, summary of the first ten chapters, and a 10 minutes audiovisual pilot.
With that work completed the owners of “titiri” started its marketing, and one year later got a deal with a Canadian company as a coproducer, and a $500.000 canadian dollars advance to do a movie.
Despite that my group had became partners with the “titiri” owners, we were not told of the negotiation. We suited them, and at present time they want to reach a financial agreement with us, and that we renounce to our rights.
Because there is little experience in the animation business in our country we don’t know how to settle the amount of the indemnity. Let’s say how much should we ask to give up our part of the project, knowing that the Canadians and the colombians plan to:
1- Realize a cartoon movie of “titiri” in Colombia, in English for the latino audience in USA and Canada.
2- Produce a t.v. series in accordance with the success of the movie
3- Market diverse “titiri” products. This, we have been told is about 70% of the profits.
We would like to know:
How to calculate our percentage of the sales of franchises
How much could we ask for retiring our names from the list of credits in an international series. (Which was the principal reason for us doing the previous work).
How much could we ask for the writing of the manual or “bible”. ( This being the most important reason for the Canadians to go ahead with the project).
I know that it not would be easy for anyone to give us a precise figure, but I would appreciate any reference, help, hint or guide that could help us to star negotiations.

Its not Possible for any one to give you a figure as no body can percieve how much business this movie is going to do, basically there are following methods of settling such claims:
1. You take a fixed value perceiving the amount of buisness this movie is going to do as a conceptualizer.
2. You calculate your expenses and round it off to certain 4 times or 5 times of that figure, because the concept that you have created has been a hit.
3. You ask them how much they are going to pay for the rights.
4. You ask them for a contract where in it enables you for a annual royalty to use those characters and the charaters remain with you as your Intellectual property.
I have tried with all that I know but you will have to formulate a plan depending on the law of your land and the law of the land of your client.
